Covid: the government presents the draft bill to exit health emergency

A draft bill expected to put an end to the exceptional regime is presented this Wednesday April 28, 2021 during the Ministerial Council, to be voted around May 10 at the National Assembly. Past June 2, the executive is to only keep exceptional jurisdiction until October 31.

How long will the health emergency be? So far, it is expected to last until June 1, 2021. The  extension has been approved by the National Assembly this past January. Deputies voted 113 for and 43 against, but they have shared their concerns and their bitterness against this always-extending scenario.

According to AFP, a bill to exit health emergency is presented this Wednesday April 28, 2021 during the Ministerial Council. Then, a vote is scheduled around May 10 at the National Assembly. On paper the draft bill allows the executive to keep exceptional jurisdiction from June 1 to October 31. If the health situation demands it, the government and the Prime Minister may still be able to pass decrees on the circulation of people or the closure of stores.

The test of this draft bill to exit health emergency is to allow the government to "regulate or - in some parts of the territority where the virus is circulating more - ban the circulation of people and cars (...) subject to strictly necessary trips to meet family, business, or health needs". This text is expected to first and foremost "respond to localized degradation of the health situation".

For the record, the health emergency enabled the government to implement curfew from 6 p.m., as well as partial lockdowns. A major text for the executive as it allows them to instate never-before-seen and drastic measures to try to curb the spread of the Covid-19 epidemic. According to the same sources, the executive is yet working on the same legal provisions in order to put an end to lockdown and curfew, still on everywhere in France.

For the record, this past November 3, 2020, MEPs were gathered at the National Assembly to vote for the extension of the health emergency in France. Not enough in the hemicycle, LREM MEPs have been beaten by the opposition. The latter passed – during a turbulent session – the extension of the health emergency up to December 14, 2020 and not to February 16, 2021 as the government first wished. The day after, on Wednesday November 4, a new twist in the situation is announced: National Assembly deputies eventually reinstate the deadline of the extension of health emergency to February 16, 2021.
